Real Property Litigation

For nearly 30 years, Craig M. Lynch has been involved in real property litigation from Kern County to Los Angeles County, handling trials and appeals involving farmland, ranchland, residential and commercial development, and real estate investment disputes.

Multiple Parties, Multiple Issues

Real property transactions involve a significant investment in terms of both time and money, from scouting and siting locations to obtaining financing and the necessary permits and licenses, to negotiating and closing the deal. If the property is to be developed, more parties become involved, including architects and engineers, contractors and subcontractors. A dispute at any stage or with any party threatens to derail the entire project.

Commercial landlord-tenant disputes may go beyond the simple matter of unpaid rent. Various express and implied covenants, such as quiet enjoyment, possession, habitability and suitability may have to be litigated.

Construction defect litigation can involve many different parties, from design professionals and general and subcontractors, to prior owners who may have altered or misused the property. Defects can exist in the design or construction and can be attributed to unstable soil or foundation problems, inadequate drainage, substandard materials and poor workmanship, or any number of negligent or wrongful actions in the building of a structure. Identifying the proper parties and understanding the relevant issues requires experience and familiarity with real property and construction litigation.

Among the myriad causes of real property litigation, some of the more common issues involve:

  • Acquisition and Development of Real Property
  • Purchase and Sale of Residential or Commercial Property
  • Lending and Financing Transactions
  • Closing and Coverage Disputes
  • Escrow Funds Disbursement
  • Failed Developments among Partners or Joint Venturers
  • Leases
  • Challenging or Enforcing Easements
  • Land Use, Zoning, Subdivisions
  • Restrictive Covenants
  • Condominiums and Home Owner Association (HOA) Actions
  • Foreclosures and Evictions
  • Landlord-Tenant
  • Construction Projects
  • Construction Defects
  • Mechanic’s Liens
  • Title and Boundary Disputes
  • Title Defects and Quiet Title Suits
  • Failure to Disclose Conditions
